TEACHER RETIRES AFTER PLEADING GUILTY TO CHARGES FOR ATTACKING A STUDENT FOR NOT STANDING FOR PLEDGE OF ALLEGIANCE

Middle school teacher Karen Smith, 60, pleaded guilty to one count of child abuse resulting in injury on Thursday.

According to Newsweek (@Newsweek), Smith’s charges stem from an incident involving a student not standing during The Pledge Of Allegiance.

Back in February, a student of Smith’s at Angevine Middle School in Lafayette accused Smith of forcing him to his feet by his jacket because he wouldn’t stand for the Pledge Of Allegiance. Smith then kicked the student out of her classroom. Smith was placed on paid leave after the incident.

According to the rules of the Boulder Valley School District, students are allowed to sit or stand during the Pledge Of Allegiance. The rules have been that way since 1943, when the Supreme Court ruled that “requiring all students to stand for The Pledge Of Allegiance violated the students’ 1st amendment rights.”

A 3rd degree assault charge against Smith was dropped as part of her plea agreement. Smith was sentenced to an 18-month deferred sentence. Meaning Smith will not go to jail, and if she keeps her nose clean for the entirety of her 18-month sentence, the conviction will be expunged from her record.
